文档介绍：I摘要随着经济的发展,土地征收补偿问题已成为社会热点,引起社会广泛关注,成为影响我国经济发展全局性的问题。我国是一个农业大国,土地是国家发展之本,管好土地问题是国家经济持续发展的重要环节,对土地征收补偿制度的完善尤为重要。但目前我国尚缺乏一部完善的土地征收补偿制度,导致在现实中出现了比较多的问题,例如,我国宪法只规定了“国家为了公共利益的需要,可以依照法律规定对土地实行征收或者征用并给予补偿。”但对补偿的原则却没有做出规定,土地管理法及相关的法律法规存在补偿标准低,补偿方式单一,补救程序无保障等,导致无法有力和有效地保护农民利益。建立一套完善的土地征收补偿制度已成为我国法制建设面临的一项迫切任务。本文基于这种需求,在对国际上一些国家的土地征收补偿制度进行研究分析的基础上,结合我国的现实情况,总结经验,进行理论研究和实践探索,提出针对我国土地征收补偿制度的合理化建议,全面分析论述了如何完善我国的土地征收补偿制度,以使其能够较好地解决土地征收补偿问题。本文由三部分构成。第一部分论述了建立土地征收补偿制度的必要性。第二部分通过对国外和我国台湾地区土地征收补偿制度的研究分析,结合我国的现实需要和社会的发展情况,对其先进经验予以借鉴,以完善我国的土地征收补偿制度。第三部分提出完善我国土地征收补偿制度的设想。本部分是本文的核心,提出了完善我国土地征收补偿制度的立法建议,制定合理的征地补偿标准,提供有效的司法救济途径,保障农民的生存权,保护农民合法权益,构建社会主义和谐社会。关键词:土地征收补偿制度;土地征收;补偿;完善IIABSTRACTWith the development of economy, the issue of land collecting pensation has e the hot issue of the society and attracted the eyes of the people all over the county, which influencing the level of the development of economy . China is a big agricultural country, the land is the root of the country’s development, to manage land problem well is a significant factor for a country’s sustainable development. So the importance should be attached on how to make pensation for land collecting more consummate. But for the moment, a lot of e out owing to ings of the pensation system. For example, The Constitution only declaration ‘to meet the public benefits, the government can expropriate lands according to the correlative laws and give pensation,’ but as for pensation’s standard, the current constitution does not make specific demonstration. The standard pensation which the law on land management and correlative laws is given low, pensation mode is too simple and pensation procedure is not satisfied. The peasants’ legal rights couldn’t be protected. So it is an urgent mission for us to do some research on the issue of pensation system for land collecting.
