文档介绍：内容摘要受贿罪是一个在现实生活中多发的罪名,随着市场经济的不断发展推进,此类犯罪变换花样层出不穷。犯罪手段也愈加隐秘、狡猾,由于现行刑法对受贿罪的规定过于粗糙和狭窄,就给犯罪分子可乘之机,他们针对现行法律采取规避法律的种种“对鲮”。虽然,政府认识到了***的危害,加大了反***的工作力度, 但收效甚微。本文认为,尽快对现行受贿罪的立法进行补充完善才是根本之道。本文立足于刑法的基本理论,从刑法学的角度,对国内外的立法进行了比较分析。通过分析对比,发现他们的受贿罪立法相对完善,相关规定都非常详尽,而且大部分国家都把非财产性利益看作***的范围。基本上没有给犯罪分子留下违法犯罪的漏洞。本文回顾了我国受贿罪立法历程,概述了中国受贿罪立法的情况,指出其没有很好的反映受贿罪的本质,导致实际上缩小了受贿罪的主体和对象,造成了立法的空白。对比港、台以及国外相关立法,联系我国的历史和现实,本文认为,我国应尽快从主体、***的对象、成立要件等方面完善受贿罪的立法, 以适应新的形势。面对打击受贿犯罪的严峻形势,不宣过多地强调刑法的谦抑性。作为“兜底”性法律,应从刑法的保障性功能出发,刑法的功利性出发,以刑法修正案的形式完善受贿罪立法,以有效打击受贿犯罪,维护公平正义,维护社会的稳定。关键词:受贿罪***立法完善刑法的保障性功能 ABSTRAcT Crime epting bribe frequently happens inthe actual life,and it’s changing infinitely,shifting pattern with the fact that market economy uninterrupted modern society,the means ofcrime isalso more secret, corporal punishment regulation to crime of accepting bribe isexcessively rough and narrow,and itgives criminals readily exploitable loopholes,they adopt avariety of”countermeasures’ to evade ,the government has realized its severe damage,the job ofanti—corruption has been enlarged,produced very little effect.
