文档介绍：I 摘要随着市场经济的繁荣和商品交易的发展,不动产交易中登记与事实不符的情况时有发生。针对由此引发的权利争议,真正权利人可以进行更正登记,但在完成更正登记之前尚有一段时间,登记权利人有可能处分不动产物权,损害真正权利人的合法权益。异议登记制度的设立目的,就在于此时充当一把临时保护伞,阻却登记的公信力,保护真正的权利人。这种辅助的临时措施,能较好地在法律对善意第三人利益的保护与对真正权利人利益的保护之间求得平衡。本文立足于民法基本理论, 依据我国现行法律规定,进行深入系统研究, 探讨如何构建完善我国的异议登记制度,以期为我国立法司法实践提供切实可行的建议。异议登记制度的提出、确立与完善,对平衡真正权利人和善意第三人的利益,保护不动产交易安全,维护市场信用具有重要的作用。本文共分为五部分: 第一部分是不动产异议登记概述,通过对异议登记的概念和价值进行分析,将其与预告登记等相关制度进行比较,对不动产异议登记内涵有整体上的把握和理解。第二部分是不动产异议登记比较法考察,先简要阐述不动产异议登记的起源, 然后从比较法的角度考察德国、日本、瑞士不动产异议登记的立法内容,具体介绍适用范围、适用情形、法律效力的规定,为后面的学****借鉴奠定理论基础。第三部分是我国不动产异议登记的程序分析, 从不动产异议登记的行使条件、公示机关、发生方式和失效情形四方面分别予以深入探究。第四部分是我国不动产异议登记的法律效力, 简要介绍不动产异议登记法律效力的两种模式后,从登记权利人、真正权利人和第三人三方面探讨法律效力。第五部分是我国不动产异议登记错误的侵权责任,从异议登记机关和申请人二角度分别论述侵权归责原则、构成要件、赔偿问题,提出引入商业保险机制的构想, 完善不动产异议登记制度的建议。关键词: 异议登记;更正登记;预告登记;登记公信力 II Abstract With the prosperity of socialistic market economy and the development of commodity transaction, the registrations sometim es disagree with the facts in the real estate transaction. The real obligee may choose to correct the regist ration for the following right conflicts. But the registration obligee may deal with the real es tate and damage the real obligee’s legal rights during the period of finishing the correc tion registration. The purpose of dissenting registration is to actin g as a temporary protective umbrella of removing the public convincing power of regist ration and protecting the real obligee. This auxiliary temporary measure could seek an in terest protection balance between the third party acting in good faith and the real obligee. This article is based on the basic civil law theory and current legal provisions to start a further systematic research and discuss about the system construction of dissenting registra tion. It is expected to provide feasible suggestions for our country’s legislativ e and legal practice.
