文档介绍：摘要审查起诉不仅是连接侦查程序与审判程序的桥梁,也有其独立的价值。公正、效率、人权保障都是审查起诉程序所追求的价值目标。科学、民主的审查起诉程序对于我国刑事诉讼公正、效率等价值的实现有着相当重要的作用。当前我国审查起诉程序存在诸如控辩地位不平等、权利不对等,不当追诉,不起诉虚置等问题。究其原因,有观念层面的,有机制层面的,也有具体操作层面的。审查起诉程序的进步和完善一方面要立足于中国的国情,另一方面也要符合刑事诉讼的基本理论和刑事诉讼的价值目标。本文除引言部分外共分四个部分。第一部分主要是分析审查起诉程序的性质和地位,指出审查起诉程序监督和引导侦查、案件过滤、启动审判的功能;第二部分主要分析审查起诉程序的价值,审查起诉程序作为刑事诉讼中一个组成部分,其具有公正、效率、人权保障的价值;第三部分主要分析了我国审查起诉程序的存在问题;第四部分主要在前三部分对审查起诉程序进行剖析的基础上,对我国审查起诉程序提出了完善的建议:首先应增强辩护方的权利,保证辩护律师权利的充分实现;其次应完善案件的分流机制,建立附条件不起诉制度,提高刑事诉讼的效率;第三,加强对刑事被害人权利保护,防止不起诉程序制约的虚置。[关键词] 审查起诉效率不当追诉诉讼分流 ABSTRACT Censorship and proceeding not only serves as thebridge linking scout and trail,but has itsown ,efficiency,human fights guarantee are thevalue and goals thatCensorship and proceeding pursues.
