文档介绍：摘要摘要作为联合国最主要的争端处理机关,安理会是联合国争端解决体系中唯一有权采取行动的政治机关,在联合国争端解决体系中处于关键性的地位,为化解争端做出了特别重要的贡献。但是,在争端解决实践中,安理会并未完全发挥其制度设定所预期的作用。本文的研究目的就是分析影响安理会争端解决机制作用发挥的因素,进而就改革和完善争端解决机制提出自己的设想。首先,本文从国际组织学角度,根据《联合国宪章》的规定以及联合国争端解决实践,对安理会现有争端解决机制进行分析并界定安理会与其他联合国争端处理机关的关系。其次,本文从国际政治学和国际法学的角度探讨制约安理会争端解决机制运作的内外部因素。笔者认为安理会争端解决机制在外部层面上受到了不断发展变化的国际格局和大国因素的干扰。在自身制度设定上,否决权制度和重要的争端应对措施一维和行动和区域办法都存在急需改进的制度性缺陷。最后,本文认为为了能适应国际格局变革的要求,积极有效地应对不断出现的各类争端,降低被大国边缘化的风险,就要对安理会现有争端解决机制进行改革和完善。采取诸如改革否决权制度,促进维和机制制度化,加强同区域组织的合作,理顺安理会与各区域组织的关系等应对措施。通过分析和研究,笔者认为联合国毕竟是国家间政治的产物,其争端解决作用发挥的有效性仍受到各成员国行为的制约。只有通过改革和完善安理会争端解决的内在机制,去顺应并且在机制上体现和促进国际格局多极化与民主化的趋势,才能有效地面对国际格局的变化所带来的挑战。关键词安理会;争端解决;机制;改革型当丕兰鎏羔堡:兰兰垡笙塞AbstractAs the most primary conflict an of the United Nations(followed short astm),the Security Council is the an which isauthorized to take action to seRle conflict and make particular contribution tomaintaining world peace。The Security Council plays key role in U-N conflictsettlement in practice of settling conflict,the Security Councildidn’t pletely as the UN Charter’S aim ofthis paperis to analyze the factors which restrict the Security Council conflict settlementsystem and bring forward corresponding project about the reform of conflictsettlement ,according to the UN Charter and the practice of the UN conflictsettlement this dissertation analyzes the existing system of the Security Councilconflict settlement and relation between the Security Council and other UNconflict ans from∞anization studies ,this dissertation discusses nle interior and exterior factors whichrestrict the Security Council conflict system from international law andinternational politics author holds the opinion that from exteriorfactors the Security Council conflict settlement system is restricted byunceasingly changing international pattem and great veto fight andimportant conflict settlement measure,peacekeeping system and regionalarrangements are in dire need of ameliora
