文档介绍：中文摘要摘要目前国际经济贸易往来中,独立担保作为一种新型的担保方式被广泛运用,促进了国际贸易的发展。但因独立担保制度固有的独立性特征,独立担保欺诈案件层出不穷,不仅仅影响了独立担保制度进一步的发展完善,而且破坏了国际经济贸易的正常秩序。独立担保欺诈产生的原因是多方面的,根本原因在于独立担保制度的独立性特征,外部原因在于各国对于独立担保制度欺诈认定存在差异,为了从根本上抑制独立担保欺诈的发生,平衡交易双方的利益,各国在建立独立担保制度的同时承认独立担保欺诈例外原则,允许法院签发止付令的形式实现对欺诈受害者的救济。但如果随意扩大欺诈的概念,必将影响独立担保正常功能的发挥,因此衡量独立担保独立性原则和欺诈例外原则具有重大的理论和现实意义。欺诈例外原则的法理基础包括诚实信用原则、公平原则及公共秩序保留原则,欺诈例外原则实现的手段主要包括担保人拒付和法院禁令。在我国对外经济交往中,独立担保必将越来越多地被应用,但国内关于独立担保欺诈的研究还处于起步阶段,我国独立担保欺诈存在较多问题,主要在于我国没有独立担保欺诈的立法及相关的司法解释,造成在司法实践中无法可依的局面。本文通过研究西方主要国家和《联合国独立担保与备用信用证公约》对独立担保欺诈制度的规定,反思我国对独立担保欺诈的立法现状,进而从实体法和程序法两方面提出完善我国独立担保欺诈例外制度的建议,以完善独立担保制度,促进我国国际贸易的发展。关键词:独立担保欺诈;欺诈例外原则;止付令英文摘要ABSTRACTIn international trade,As a modem international credit guarantee,Independentguarantee have long been playing a vital role in guarantee promotesthe development of international ,because of the inherentcharacteristic of independence of independent guarantee and plexity of theinternational trade,the independent guarantee fraud case has occurred fre; only affects the normal order of international trade seriously,but also influencesthe value of independent guarantee are many reasons for the happeningof independent guarantee fundamental reason is the characteristic ofindependence of independent guarantee and the external reason is that differentcountries have too many differences in judging the independent guarantee order to control the ofindependent guarantee fraud and balance theinterests of both parties,countries establish the independent guarantee system,andt11ey acknowledge fraud exception principle at the same time to allow the court toissue injunctions against the issuer to pay the Fraudulent beneficiary,in order torelieve the victims of independent guarantee ,it must be harmful tothere gular nations of independent guarantee if the interpretation of fraud ,it is beneficial to reach a Balance between the principle ofindependent gua
