文档介绍：摘要中文摘要林权登记源于林权管理和保护林权权利人合法权益的需要,完善的林权登记制度能够为林权改革提供制度支撑,衔接林权登记制度理论研究与实践需求的脱节, 以巩固集体林权改革的成果。本文从民法的视角出发,以狭义的林权概念为基点, 以林权登记的内容和法律效力、林权登记的规则设计、林权登记簿的完善以及林权登记错误的救济为体系,构建林权登记制度。林权登记的内容应契合集体林权改革的目标,按照林权的具体权利类型确定登记内容,并赋予其对抗效力、推定效力及公信力等法律效力。为了保障林权登记制度充分发挥制度功能,必须有一套设计严谨,符合实践需求的登记规则。通过走访实务部门***、运用归纳总结的方法, 提出登记规则应确立以共同申请为原则、单方申请为例外的登记申请模式,并采实质审查为登记审查模式,同时辅之以责任分担机制等配套措施。而在林权登记簿中, 以实例分析为基础,提出应吸收预告登记和异议登记两项登记类型为林权登记类型的基本内容,以适应新一轮林改的需求,实现林权登记制度与《物权法》的有效对接。同时,为了实现对林权人权利的救济,在明确林权登记错误赔偿责任为民事赔偿责任的基础上,可通过确定赔偿责任的构成要件、界定赔偿责任的范围,并根据林权登记的特性,创新赔偿责任的承担方式等途径,完善林权登记错误的救济体系, 实现法律制度价值的平衡。关键词:林权登记登记效力公信力实质审查预告登记登记错误福建师范大学全日制硕士学位论文 Abstract For thepurpose offorestrightmanagement andthe protection oflegalrights, registrationsystem ofChina’S e system can support theforestright reform andjoin theremoving betweent thetheory research and practical by thecivillawandbase Oilthenarrowly defineoftheforest right,we could built theregistrationsystem of forestright,that is,thecontent,the law effect,the regulationdesign,theregisterimprovement andthe reliefofreg=i【******@nor content ofthe forestright shuldmatchthetarget ofthe collective forestrightreform,according tothespecifictypes oftheforestright,we could define thecontent oftheforestright andendow theregistration effectofantagonism, presumption ofvalidity order to elISUl'O theregistrationsystem of forestrightcouldplay thefully part on thesystem fuetion,we must have aregulation which isstrictand meetthe need way ofinterviewthefor鹤try sectorand collectdata,take advantage ofinductionandsummary methods,we considerthat the registration regulation shouldestablishthemode ofthat,joint application astheprinciple and independent application as the ,We could choose the substantive review andassorttheduty sharesystem theregister,base on the reformexample,we believethatinorder toadjust tothe new reformand achieve thetarget t
