文档介绍：摘要社会福利是国家和社会为维持和提高社会成员的生活质量而提供的物质帮助,以满足社会成员的共同和特殊生活需要的社会保障制度。对于残疾人而言,享受国家保障的安全、健康、幸福和舒适的生活状态,是一种权利,还是一种恩惠?这是本文的核心议题。文章按照从“应然”到“实然”再到“建议”的逻辑顺序论述。通过对公民资格理念及公民社会权利内涵的分析,审视我国残疾人社会福利法律制度的现状:我国已从法律制度层面构建了残疾人基本的社会福利,但在残疾人社会福利观念和制度中普遍缺乏公民社会权利的价值基础。本文认为公民社会权利是残疾人平等享有社会福利的理论基础,现行体制中城乡二元结构、地区差异导致残疾人社会福利的差别待遇是对残疾人社会权利的限制,对此在法律制度中应作以完善。通过对英国、德国以及瑞典三国残疾人社会福利法律制度的价值理念和实践经验的比较研究,完善我国残疾人社会福利法律制度应以维护和实现残疾人社会福利权为根本,将平等作为残疾人社会福利法律制度的价值目标,最终实现整合社会与谋求发展的目标体系。具体讲应完善残疾人社会福利立法,加强住宅福利法律制度、教育福利法律制度、医疗福利法律制度的建设和资金投入平衡职业福利的落差,给予城市贫困残疾人和农村残疾人更多的政策倾斜和福利资金支持,使其能过上正常、基本的生活。关键字:公民资格;公民社会权利;残疾人;社会福利法律制度 Abstract Social welfare is akind ofsocial securitysystem tomeet the eonlnlon and special needs,to provide materialassistanceby the stateand society tomaintain andimprove thequality oflifeformembers of aright or afavor toenjoy nationalsecurity,health,happiness fortable lifefor disabled person?11lis the core topic ofthepaper.
