文档介绍：中文摘要选举权是我国公民的一项基本政治权利,具有普遍性、平等性。选举权的保障程度是衡量一个国家文明程度和民主化程度的重要标准。我国选举法设立了许多具体规则,保障了公民选举权的行使。然而,随着我国由农耕文明向工业文明的过渡以及城市化进程的加快, 人口流动的规模不断扩大,流动人口数量也在不断增加。在选举实践中,流动人口选举权的行使和被选举权的实现陷入了层层困境,并导致与选举制度产生了强烈的冲突和矛盾,给选举制度体系及其运作带来了新的问题,直接影响到选举的结果和质量。因此,我们应采取有效措施,推动选举法的修改和完善。本文拟对我国流动人口的选举问题进行研究,以期从制度层面上对如何保障我国流动人口的选举权提出一些可操作性的建议。本文共分为四章。第一章主要介绍了我国流动人口的概念、特征, 我国选举制度中选区划分和选民登记的沿革,以及我国相关法律关于流动人口选举权和被选举权的规定。第二章主要介绍了我国流动人口的选举困境,及与我国现行的选举制度在法律、制度设计和运作、选举制度的原则方面的冲突,并深入分析造成流动人口选举权无法落实的原因。第三章介绍了美国和俄国的选民登记制度,以及我国浙江义乌市的流动人口选举模式,分析值得借鉴的地方和我国义乌模式存在的不足。第四章从选举制度和户籍制度两方面,提出了一些可操作性建议,如完善我国的选举法,改革选民登记制度等,探索流动人口选举权的实现路径,期待流动人口的选举难题得到彻底的解决。关键词:选举制度;选举权;流动人口 ABSTRACT China’S citizens the right to vote is a basic political rights,universal,equal level ofprotection the right to vote is a measure of the degree of civilization of a country and an important criterion for the degree of democratization.
