反倾销和反补贴法律中的FA规则研究

摘要
“”规则是反倾销和反补贴调查中被诉企业不应诉或消极应诉时面临的
首要规则之一,该规则主要应被用以防止反倾销调查中受调查的出口商拒绝或
不在合理期间提供所要求的数据,或者严重阻碍调查。与此同时, 《反倾销
协定》及其附件2对反倾销调查主管机关使用规则也设置了程序上和条件上
的限制,但另一方面,在反倾销调查主管当局享有缺乏严格而明确约束的自由
裁量权的情况下,该规则也极可能被用来作为推行贸易保护政策的工具。我国
作为世界上重要的贸易大国,对反倾销和反补贴法律中的规则的研究就显得
尤为重要。我国的出口企业在遭到外国反倾销调查时,应注意积极应诉、“尽最
大努力”及时、准确地提交调查问卷所要求的信息,避免主管当局采用“最佳
可获得信息”,并在外国(地区)反倾销调查主管当局滥用“最佳可获得信息”
情况下,谋求我国政府进行交涉或将争端提交争端解决机构解决。

Abstract
FA rule is anti-dumping and countervailing investigation or being sued respondent enterprises
do not face the negative appearance of one of the primary rules, the rules should be used primarily
to prevent the anti-dumping investigations exporters under investigation or not to refuse a
reasonable period of to provide the requested data, or seriously hamper the investigation. At the
same time, WTO "Anti-Dumping Agreement" and its Annex 2 to the anti-dumping investigation
authorities also provided the use of FA rules on the procedures and conditions of the restrictions, but
on the other hand, petent authorities of the anti-dumping investigation and clear enjoyment
of the lack of strict restraint of free discretion case, the rule is likely to be used as a trade policy tool.
As the world's most important trading power, the anti-dumping and countervailing laws of FA rules
is particularly important. China's export enterprises by foreign anti-dumping investigation, the
respondent should pay attention to the positive, "do their best to" timely and accurate submission of
the questionnaire requested information, petent authorities to avoid the use of "best
available information", the pursuit of our government to negotiate or to submit the dispute to
resolve the WTO dispute settlement body.
