摘要
正值奥运尾声的三鹿婴幼儿配方奶粉事件震动了全国,乃至世界(亦或先
震动世界,再震动全国)。我们应该看到,在这个诚信观念普遍缺乏的时代,国
家产品免检制度有着诸多的弊端,其致命的缺陷那就是妄想靠企业的自律来保
证产品质量,这无异于拿广大人民的人身健康和生命安全来考验。人是一切价
值的尺度,任何企业,都必须以对生命健康的敬畏作为第一要义。本文试图对
我国避免“三鹿奶粉事件”悲剧重演的根本出路等问题作一些探讨,以期能为
产品质量问题尤其企业的社会责任问题在法律层面的最终解决提供一些有益的
帮助。此外本人还认为把企业的经济价值取向与诚实守信的道德价值取向统一
到行为中,这是企业增创新优势和面对国内外激烈竞争态势的必然选择。保障
企业在制度与法律的双重约束与驱动下,实现企业社会责任的更好实现。

Abstract
Just when the Olympic Games last act's three deer babies and infants powdered formula event
shocked the nation, and even world(Also or vibrates the world first, then shocks the nation)。 We
should see that in this good faith idea universal deficient time,the national product exempting from
inspection system has many malpractices, its fatal flaw that is the delusion depending on
enterprise's autonomy quality assurance, this is no different with takes the general populace's person
health and the safety tests. The human is all value criterion, any enterprise, must by take the first
essential meaning to the life and health awe. This article attempts to our country to avoid questions
and so on basic outlet which “three deer powdered milk event” the tragedy repeats making some
discussions, can solve finally especially take the time as the product quality question enterprise's
community responsibility question in the legal stratification plane provides some beneficial help. In
addition myself also thought that unifies in the behavior enterprise's economic value orientation and
the honest code of honor's ethical value orientation, this is the enterprise creates the new superiority
and facing the domestic and foreign petition situation choice inevitably. The safeguard
enterprise in the system and under the legal dual restraints and the actuation, realizes the enterprise
community responsibility to realize well
