摘要
信用卡是一种先进的信用凭证。它对服务人们的生活和提高生活质量起到了
至关重要的作用,但同时它也是一项高风险的业务,成了犯罪分子攫取钱财的重
要阵地。虽然我国政府将这种行为上升到了刑法的高度去规制,但信用卡诈骗罪
的犯罪率还是居高不下,一个很重要的原因是在对于这种新型的犯罪的理论研究
上,还有许多不完善的地方。笔者从以下几个方面着手进行了研究:首先对信用
卡诈骗罪中“信用卡”的含义进行了明确,指出了“信用卡”采广义之说既包括
借记卡,又包括贷记卡;其次在信用卡诈骗罪的定义的界定上,通过对其他学者
的定义的剖析,重新赋予符合刑法规定的定义;再其次在信用卡诈骗罪的犯罪构
成问题中,用中外学者的理论阐述了比较符合信用卡诈骗罪的犯罪构成理论,从
多方面证明了单位应该构成信用卡诈骗罪的主体、在主观方面重新界定了非法占
有公私财产是其应有之目的、信用卡诈骗罪的复杂客体的重新论证、客观方面犯
罪对象的公私财产性进行全面研究;对于信用卡诈骗罪的司法认定方面,从利用
网络实施信用卡诈骗的行为从其表现形式入手,从其客观方面和国际的立法等角
度界定出其性质属于一般诈骗罪。对三角信用卡诈骗行为的司法认定做出了系统
性的分析,从犯罪构成的符合性和刑法规定的符合性两个方面论述了三角信用卡
诈骗行为应该属于信用卡诈骗罪的行为之一。对抢夺信用卡并使用的行为和利用
短信进行信用卡诈骗的行为的性质作了比较合理的认定;最后提出了信用卡诈骗
罪的防范对策,先从信用卡诈骗的原因入手,系统的分析了此罪诈骗的社会原因、
经济原因、管理原因等,找到了信用卡诈骗的症结之所在,而后从宏观防范和微
观防范两个方面系统全面的进行了对策研究。

A credit card, known as “electronic currency”, is a kind of advanced credit
credence. It acts the important function to serve people life and improve the quantity
of life, but at the same time, It is also a high risk profession and es a important
battlefield where the crime numerator lays hands on the money. Our country
