摘要
道路在经济生活中占有重要地位。被誉为“魅力湘西、神秘湘西”的湘西土
家族苗族自治州地处湖南省西北部,是个多民族居住的社区。作为著名旅游胜地,
它拥有迤逦的自然风光,独特的少数民族风情,而对于长期生活在这里的群众,
连绵不绝的山脉则成为经济发展的天然障碍。少数民族地区农村要发展,首先就
是要解决交通问题,可是对一个经济能力有限的村寨来说,修成一条公路谈何容
易?本文即是通过描述一个苗族村寨修建村级公路的过程,探索在村寨这个范围
内,怎样运用国家政策与民族长期遵循的习惯法方法,最终完成道路建设,开启
经济发展序章的。
论文主体部分(第一至三章)按照道路建设一般逻辑,展现前期动员、资金
筹备、获取土地和劳动过程等环节中习惯法的应用:村干部们在国家法和习惯法
中不同的身份和职能;人不吃路的乡村社会行事心理基础;自筹资金对国家支持
公共基础设施的补充;以家族为基础的劳动合作的具体操作等。第四章对习惯法
在基础工程建设中具有重要作用进行总结。
苗族习惯法是苗族人民在历史长河中积累的生产、生活经验、规则。通过探
究道路建设这一具体活动中习惯法的应用,不仅能侧面展示出习惯法在整个村寨
中的地位,验证习惯法在少数民族村寨中发挥的作用,也能揭示苗族传统文化在
现代社会中所具有的主体精神,给予我们当代人更深远的启示。

Abstract
Xiangxi Tujia and Miao nationalities autonomous prefectures were pronounced as
a "charm and mystery Xiangxi " which located in western Hunan province, is a
multi-munity. As a famous scenic resort, it has beautiful natural scenery, the
unique minority custom. However, continuous mountain is a natural barrier for native
people to develop economy. Solve the traffic problem is the first problem for minority
regions to develop economy. But it is too hard for an ability limited village to build a
road .The thesis is to describe a process of building the road in the village and explore
how to use national policies and the village customary law pleted road building
finally, and start the chapter of economic development.
The Miao customary law people is the experience and regulations which
accumulate during the production and living of Miao in history. In the process of road
construction, such as finance, labor, organizations and conflict solving are embodied.
The thesis explores the application of customary law though road construction activities
can show the profile of the customary law position throughout the village, which prove
the affect of customary law in the minorit
