摘要
随着社会经济的快速发展,人们对资源的依赖也与日俱增,矿产资源开发力
度和消耗量逐年增加,经济发展和生态破坏像一对孪生兄弟一样如影随形,在推
动社会经济发展的同时,又给原本脆弱的生态环境带来巨大的负面影响。本文从
矿产资源开发生态补偿法律制度的基本内涵入手,以人权保障理论、公共负担平
等理论和国家责任理论等作为理论支撑,以包头市为例,揭示矿产资源开发对生
态产生的巨大危害,生态恶化、水土流失、废气排溢、山体滑坡、土地沙漠化加
剧和水资源、土壤污染等,阐明构建生态补偿法律制度的必要性和迫切性。在综
合国内现行生态补偿法律制度的基础上,发现相关法律制度不健全、制度实施不
到位、生态补偿基金征收使用不合理等一系列问题,据此从加快立法、拓宽资金
来源渠道、完善公众参与制度等方面提出建设性意见。

Abstract
With the rapid development of social economy, people increasingly rely on
resources, mineral resources development strength and consumption also in increase
year by year, economic development and ecological destruction like twin brothers in
bedfellows, promoting the development of social economy, and also gives the fragile
ecological environment has brought great negative impact. This article from the Mineral
resources development and pensation legal system of basic connotation
of the basic connotation , human rights theories, public burden equality theory and
national responsibility theory as the theoretical support, reveals the mineral resource
development of ecological Baotou produce big harm, ecological degradation, soil
erosion, direct vent overflowing, landslides, land desertification aggravate and water
and soil pollution and so on, clarify construction pensation legal system
and the necessity and urgency. In prehensive domestic current ecological
compensation legal system, found on the basis of relevant legal system is not perfect,
the system implementing does not reach the designated position, ecological
compensation fund imposes use series of problems, such as unreasonable from
accelerating legislation, broaden on funding sources, better public participation in the
system of put forward a constructive suggestion.
