我国农村集体土地所有权变革的困境与出路

摘要

自有人类社会以来,有关土地归属和利用的种种制度设置
和制度运行,便始终与社会安宁和社会发展紧密相连。中国农
村土地制度自建国以来几经变革,时至今日初步确定了以土地
家庭承包责任制为主要内容的土地利用制度。该制度提高了农
民的生产积极性,极大地解放了农村生产力,推动了农村经济
的发展。但是在进一步深化农村改革的过程中,日益暴露出一
些缺失与不足。比如:所有权主体虚位、权能不全、集体所有
权与国家所有权界限不清等。这些缺失与不足已经成为进一步
推进农村经济体制改革的“瓶颈”。因此,改革完善现行农村土
地制度便具有了现实的迫切性与必要性。围绕着物权立法,学
术界就农村土地制度的改革与完善提出了许多方案。有的学者
主张保留现有的集体土地所有权,对之加以完善,也有的学者
主张取消农村集体土地所有权,实行农村土地私有化。但这些
方案均难尽人意。农村集体土地所有制是农业生产合作化和人
民公社化运动的产物,具有很强的政治意蕴,在这样的制度架
构内,不可能找到根治现行农村土地制度痼疾的“灵丹妙药”。
土地的经济社会属性、加强耕地保护以及确保粮食安全使农村
集体土地国有化具有正当性和必要性。本文认为,国有化是走
出农村集体土地所有权变革困境的最佳选择。并提出了许多具
体措施,如:理顺现行土地管理体制,在加强土地地籍管理的
基础上将集体土地收归国有,建立以农地使用权抵押为特征的
农村金融制度,使国有化的变革思路具有可行性。

Abstract
Since the existence of human society, the setting up and
running of all kinds of institutions toward land owning and utility
closely connects with the rising and dealing of the regime and
humanity’s happiness intensely. Land institution has been
transformed several times since the foundation of the People’s
Republic of China. And now the land utility institution that the
household responsibility is its major substance has been
established initially. This institution enhances the farmer’s
production enthusiasm and not only liberate rural production forces
greatly but also promote the development of rural economy. But it
reveals itself some imperfections and shortages progressively in
the course of deepening the rural reform. For example: 1. Subject
of landownership is weak 2. Collective landownership has a false
position 3. Collective landownership has a not pure boundary with
state land ownership. These imperfections and shortages have
e obstacles to deepen the rural reform. Therefore there has
real urgency and necessity to reform the current rural land system.
