摘要
只要人类存在一天,就需要有规则来规范社会秩序,社会秩序的建构和维持
是人类永远不可回避的问题。当前,我国正处于社会转型期,各种社会矛盾凸显,
在维护社会秩序的规则体系上,存在着民间规则与国家制定法并存的情况,并且
二者在一定程度上存在冲突的现象。随着现代化的快速推进,依法治国战略的推
广,调整社会秩序的主流规范已经是国家制定法,民间规则发挥作用的空间越来
越小,国家制定法对民族地区的影响越来越大。在国家制定法深入乡村社会的同
时,也出现了各种各样的问题,如对国家制定法的规避,民间规则与国家制定法
的冲突等现象。带着这些问题,本文以民族地区村庄为例,通过深入的田野调查,
在前人研究的基础上,探讨了国家制定法与民间规则在乡村社会的作用以及相互
关系等问题。
本文通过田野调查,考察了民族地区乡村社会民间规则的种类、运作过程,
以及国家制定法在乡村社会的作用,进而分析二者在乡村社会中的冲突与互动。
通过对民间规则与国家制定法在乡村社会对纠纷解决的考察,反思国家法律现代
化问题。笔者认为法律的现代化是民间规则与国家制定法相互博弈的过程,二者
的冲突与互动是中国乡村法治的必然,在依法治国的今天,民间规则的作用不可
忽视,为了更好的实现中国法制的现代化,需要我们充分了解和利用民间规则,
吸收民间规则的合理成分,而不能过分强调国家制定法的统一性,只有二者的相
互结合才能维护好乡村社会的秩序。

Abstract
As long as mankind exists,we need rules to regulate the social order,construction
and maintenance of social order can never be evaded by human. At present, China is
undergoing social transition, and various social contradictions highlight. System of rules
to maintain social order, the existence of rules and constitutional law of civil co-exist,
and to a certain extent, both the phenomenon of conflict. With the modernization of the
rapid development of the strategy to promote the rule of law, adjusting the mainstream
norms of social order is already a State Law. Role of civil rules are fewer, and national
Law of the increasing influence of ethnic areas appeared. In the countries to develop
methodology to rural society, it also appeared in a variety of issues. Such as
circumvention of the state statutes, rules and constitutional law of civil conflict and so
on. With these questions, this village as an example of ethnic region. Through in-depth
of field research, in the basis of previous studies to explore the countries to develop
laws and civil rules in the role of rural and other issues of mutual relations.
