美国特殊儿童的教育权利立法保护研究

特殊儿童是社会中的一个需要受到特别关注的群体。在我国,特殊儿童的教育问题虽
然已经受到了党和政府的大力支持,但是由于这方面重视的较晚,而且又缺乏相关的理论
研究和实践指导,因此,还有相当一部分特殊儿童没有享受到应有的教育权利。
“它山之石,可以攻玉”,借鉴发达国家的特殊教育经验,有助于推动我国特殊教育
的改革与发展。美国的特殊教育事业可以说是位于世界前列,我们有必要对美国的特殊儿
童教育权利立法保护问题进行深入探讨,借鉴其先进教育理念及方法使我国的特殊儿童能
够充分享受到应有的受教育权利。
本文主要采用、比较研究法、历史研究法、因素分析法等研究方法,通过文献综述和
比较研究对美国特殊儿童的教育权利立法保护进行深入探讨。本文分为三个方面进行研
究:首先,从特殊教育发展的历史角度来研究。美国特殊儿童的教育权利之所以能够受到
政府的重视并且得到法律的认可,是在特殊教育发展到一定的程度、公民的意识达到一定
的高度的基础上实现的。因此,我们有必要追溯美国特殊教育发展的历史及背景。其次,
从教育立法方面研究。美国是一个讲求法治的国家,特殊教育立法较早、内容也相对完善,
因此,美国通过法律手段赋予了特殊儿童享受特殊教育的权利。第三,从特殊教育的教学
管理方面研究。特殊儿童的教育权利受到保护也体现在日常教学管理的各个细节方面,如
师资培养、课程设置等等。

The research of legislation about special children’s
education rights in America
Abstract
The children with disabilities are a group of our society, and they need particular attention.
In China, though the problem of special children have been taken seriously, our country in this
aspect of the later on, and lack of theoretical research and practical guidance, therefore, there is
no part of the special children's education should enjoy the rights. Special children should enjoy
the basic rights that were the same with everyman, live together and to participate in various
activities, wherever the activity is in school, family or workplace.
“The stone of hill could smite jade”, use the reference of the special educational experience
in the developed countries, it is helpful to promote the reform and development of special
education. American special education career is located at the top of the world, it is necessary
for us to discuss America's special children education rights issues.
This paper adopts such research methods parative research, historical research,
factor analysis, etc. Study American special children's education rights protection problems in
the way of lite
