社区矫正的司法行政法律问题研究

摘要
我国自 2003 年开始了社区矫正的试点工作,社区矫正的理论和实践都取得了初步
的成绩并积累了一定的经验。但我国的社区矫正的司法行政工作还存在着一些问题和缺
陷,如社区矫正的司法行政权力的性质、归属不明确,社区矫正司法行政的主体多重化。
这些问题和缺陷的存在影响了社区矫正改造罪犯的效果,阻碍了我国社区矫正的发展
进程。
要解决这些问题必须认真分析社区矫正司法行政权的性质,明确社区矫正司法行政
权的归属。应当结合我国在改造罪犯方面的传统经验,进一步明确社区矫正的司法行政
机关的职权与职责以及被矫正人员的权利与义务,同时借鉴国外社区矫正的立法、主体
的地位与职权等有益经验,解决司法行政机构负责社区矫正司法行政工作所面临的困
难,使社区矫正的司法行政的对策措施更为完善。

Abstract
Abstract
A pilot project munity Correction have been operated since 2003 in China,
and it has made initial achievements and accumulated some experience in the aspect of
theory and practice. However, there are still some problems and ings in the work
munity Corrections which affecting the rehabilitation of offenders munity
correction effect and hindered the development process of China'munity correction.
To solve these problems, we must be carefully analyzed judicial administrative
authority munity corrections and made its ownership clearly . Administrative
organization of justice carried out the right munity corrections has an advantage over
these bined with traditional experience in the rehabilitation of offenders,
community corrections clear terms of reference of the judicial administrative authority and
responsibility, and by correcting the rights and obligations of staff, referring to foreign
community corrections legislation , the main body of useful experience and terms of reference
of judicial and administrative bodies responsible munity corrections administration of
justice and the difficulties with the facilities to improve the administration of justice,
community corrections countermeasures.

二战以后,人权问题逐步成为时代的一个主题,刑事执行和罪犯处遇成为国际社会
普遍关注的问题。监禁刑作为刑罚体系的核心,对罪犯的权利有着直接的影响,一度受
到人们广泛的关注。高技术信息是当今社会的最重要的特征,但是监禁刑将罪犯置于封
闭的监狱内,使罪犯与社会的不相容程度有所扩大。罪犯生活技能相对落后
