文档介绍：摘要随着我国城市化进程的加快和市场经济的迅猛发展,农村集体土地被大量征收和征用,随着征地速度逐年加快,土地这一不可再生的稀缺资源J下在日益萎缩, 失地农民越来越多。“三农问题"是我国目前最突出的社会问题之一,农民问题则是“三农问题”中的核心问题,而失地农民问题又是农民问题中最迫切需要解决的问题。失地农民人数庞大,由于失去了基本的生活保障手段,加上自身没有一技之长,所以大多数失地农民处境艰难。其主要原因是农村土地征收补偿标准低,补偿范围窄,农民受益太少。我国现行土地征收及补偿制度是传统计划经济条件下的产物,在市场经体制条件下,该制度存在对公共利益的规定过于模糊,政府职能错位,背离市场经济规律,补偿标准低,补偿范围窄等缺陷,已经不能适应社会的发展。现行的土地征收立法本身存在的冲突和不足,加上法制观念的欠缺,公权力严重侵犯私权利,产生了严重的社会后果。土地征收及补偿制度的完善,应当选择全面改革的道路。改革的具体措施包括:严格限定公共利益的范围,严格限制征收权力的运用,完善土地征收程序, 提高土地征收过程的监督,提高宪政和法制的意识,切实保护私权,扩大补偿范围,提高补偿标准等。本文以农村土地征收补偿问题为切入点,以提高失地农民应得补偿标准为中心,以制定我国《农村土地征收补偿法》为重点,提出保护失地农民合法权益的建设性意见。关键词: 土地征收补偿制度公共利益 V Abstract As the acceleration of our country’s urbanization process andrapid development ofthe socialistmarket economy,large number of ruralcollective land requisition speeds upevery year,thus land,a nonrenewable rarel'esource,shrunk and morepeasants losetheirfarm land.
