文档介绍:内容摘要全球经济的发展,大量石油由船舶经海上从石油输出国运往石油输入国,船舶油污所造成的污染损害也相伴而生。船舶油污损害后关键是赔偿问题,有关船舶油污责任主体的确定,则是油污损害赔偿中的核心问题。世界上绝大部分石油进出口大国,都有自己完善的船舶油污赔偿体系,确定油污损害民事责任主体。然而,我国没有专门的船舶油污损害赔偿民事立法。尽快确立海上船舶油污损害民事责任主体,既是我国经济社会发展的现实需要,也是我国立法急需解决的问题之一。本文主要解决两个问题:哪些主体可纳入船舶油污损害民事责任主体;确定他们承担责任要件是什么。首先,在界定清楚船舶油污损害民事责任主体中“船舶油污”、“民事责任主体”后,探讨了油污损害民事责任主体所涉法律问题,其次分析国际法中船舶油污责任主体相关规定,指出其不足。比较分析美国OPA90 和加拿大船舶油污损害制度中责任主体,总结出共同点和各自特点,并归纳出当前油污责任主体的发展趋势。在对油污责任主体立法完善进行理论分析和实证分析基础上,论证了船舶油污主体承担社会化的趋势,以及严格责任在确定油污损害民事责任主体的必要性。最后,联系我国船舶油污现状,对我国船舶油污立法中船舶油污责任主体相关立法,提出几点建议。关键词:船舶油污责任主体严格责任油污赔偿基金 Abstract With theglobal economic development,a great dealofpetroleum shipped into importing countries from exporting countriesby sea,following with ship oilspills which makes ocean pollution damage isthemostimportant thing afteroilpollution,and theobligor ofoilpollution damage from ship take avery important isnoted thatsome major marine countries have establish special law system toregulate pensation liability inrcspea of ,there is no special civillegislation pensation forpollution damage by ships theobligor ofoilpollution asso叫aspossible is not only therealisticdemand of our country’S economic socialdevelopment,but also anurgent problem need tobesolved in our country’Slawmaking.
