文档介绍：摘要摘要随着社会经济的发展,财产在夫妻关系中的作用也越来越突出,夫妻财产争议也不断暴露出来。在以往人们在离婚时提出的财产分割请求在现在的实际生活中也越来越多出现在婚姻关系存续期间,也就是说当事人选择分割财产但是保留婚姻关系。但是2001年《婚姻法》对夫妻财产分割的规定是要求夫妻双方协商一致否则只能在离婚时提出,这使得人们在面临这类纠纷时感到无所适从。《物权法》以及《婚姻法司法解释(三)》出台,体现出夫妻共同财产的婚内分割已经在我国立法中露出了的尖尖一角。但新的司法解释本身存在不足使得其在解决实际纠纷中并不能充分发挥应有的作用。夫妻在婚姻关系存续期间的财产关系应当由专门机制进行调节,而不是仅仅靠部分部门法中的个别法条进行规范。在维持婚姻关系前提下解决夫妻关于共同财产的权属纠纷成为本文探讨对象。本文包含三个部分。第一部分:介绍婚内共同财产分割制的概况。对比介绍了国内学者和国外立法对婚内共同财产分割的表述,在此基础上,笔者明确了这一制度的概念。并根据适用原由的不同将婚内共同财产分割制分为当然适用和法院宣告两种类型。明确本文着重讨论的对象是后者。第二部分:通过分析婚内共同财产分割制的价值,明确了的本文的研究意义。并且分别从理论和实践两个方面论证了婚内共同财产分割制在我国构建的必要性和可行性。在此基础上,笔者又针对《物权法》和《婚姻法司法解释(三)》中的有关规定进行了介绍和评析,肯定我国立法在婚内财产分割方面的进步,认识到仍然存在的缺陷和不足,主要集中在立法模式、适用情形、资格主体、效力问题等方面。第三部分:在第二部分的分析基础上,对以法国、德国、瑞士、意大利、澳门等国家和地区为代表的相关立法进行了考查。对其在立法模式、适用情形、资格主体、效力问题等方面的规定进行了集中介绍,并对具体规定的合理性和科学性进行分析。最后以此为借鉴,在符我国实际情况的前提下,提出笔者对中国构建和完善该制度的具体立法设计和建议。关键词:婚内分割;共同财产;物权法;婚姻法司法解释(三);立法思考 Abstract ABSTRACT With therapiddevelopment ofChina’Ssocialeconomy,property plays amore and more important roleinpeople’S lifeand marital property disputes have e disputes exist not only atthetime ofdivorce but also during theexistence ofvarious reasons,the husband orthewife only makes anapplication tothe court forproperty division without , there are conventional munity property during the existence of marriage can not beseparated unless the couple get divorce,which makes people don’tknow what course totakewhen faced with disputes ofmarital the Real fight law ofthepeople’S Republic ofChina and thethirdjudicial explanation of China’SMarriage Law munity property division during theexistence ofmarriage e one part ofChina law theshortages ofthenew judicialexplanation keep itback from giving fullplay totheroleofsealing marital property property relationship should beadjusted by aspecial legal system,not several articlesbeing distributed insome codes.
