论卧底侦查
摘要
卧底侦查作为一种不同于常规侦查模式的侦查手段，在侦破有组织犯罪及“无受害人犯罪”中具有显著的破案效果。但如果不对其加以严格的法律规制，就可能出现破坏法制、侵犯人权的后果。以立法手段促进卧底侦查的法制化运作，已成为我国刑事立法的当务之急。在卧底侦查的立法化方面，应着重解决五个方面的问题：一是确立卧底侦查的合法化的基本原则；二是明确规定卧底侦查的适用对象；三是建立对卧底侦查的监督约束机制；四是加强对卧底侦查人员的安全保障；五是建立卧底侦查侵害的救济制度。

Abstract·
Undercover investigation as a differs from the conventional mode of investigation investigative means, in investigating organized crime and" victimless crimes" have significant effect. But if not be strict legal regulations, there may be legal, human rights violations in consequence of damage. By legislative means to promote the undercover investigation legalization operation, has become a pressing matter of the moment of criminal legislation in our country. In the undercover investigation of the legislation, should focus on solving the problem of five respects : one is the establishment of the undercover investigation of legalized basic principles; two is the clear provisions of undercover investigation objects; three is to establish a supervision and restraint mechanism of the undercover investigation; the four is to strengthen the undercover investigation personnel security; five is built undercover investigation against the relief
