文档介绍：中文摘要中文摘要***作为~种客观存在的行为模式,在人类数千年的历史中,无论在西方国家还是在中国,都一直存在着,且长期以来,***者受到了来自社会的重重压力、歧视、甚至是迫害。随着社会的不断发展和变迁,***者权利运动和人权运动逐渐在一些国家和地区得到不同程度的完善和发展,***者争取自身平等的法律地位和婚姻权利的呼声不断高涨。***已不单单是一种文化现象,而且已成为一种社会问题。其中不少国家通过制定相关法律承认了同性婚姻制度, 对***者的权益予以保护。目前在中国,关于***者婚姻权是否立法保护的问题,仍是一片空白。本文试图通过***者的现状、社会评价、婚姻权利平等性的分析途径,达到保护***者的婚姻权,借以维持社会秩序的目的。文章分为三个部分: 第一部分介绍***的科学认知。简单阐述***的涵义及***者的现状, 介绍***名称的由来及国内外***者的状况。通过对***者的客观评价概述,进一步认识***自古就有,且是一种社会事实。同时,通过我国对***的事实评价,让社会对***者有一种正确客观的评价,使人们思索怎样对待***者;思考婚姻的实质,考虑怎样在立法的领域保障***者的权利。第二部分从婚姻的本质、目的、同性婚姻、***与同性婚姻的关系等方面论述***者应该享有与异性平等的婚姻权,提出***者婚姻权应得到我国的立法保护的建议。第三部分提出***者婚姻权的法律保护问题,将国外有关***者的婚姻立法保护模式逐一提出,作为中国在***者婚姻立法保护不容忽视的重要理论。同时,进行法律效力的评析,让我国在***立法方面更好地把握规制的方向, 探索出我国***者婚姻权的法律规制思路。为了社会秩序的稳定,结束***者的非正常的生活,在中国选择什么样的规制模式将具有重大的现实意义。关键词:***者;同性婚姻;立法模式黑龙江大学硕士学位论文 Abstract Homosexuality,ilLS awidespread behavioural paaem,has ever been inexistence objectively,whether intheWestern countries or inChina,for thousands ofyears in huamn for along time,the gays have been confronted with the social pressures,discriminations or even severe thedevelopment and the change of our society,the human rights movement and thecampaign forgay fights in some countries orregions have been developing stepbystep and perfected to avarying gays’fight forequal legal status forthemselves and thecallfortheright to equal marriage have been is no longer aculturalphenomenon initself,but otherthings,quite afewcountries haveofficially recognized gaymarriage bypassing lawsconcerned,thus protecting theinterests ofthe gays and quite afewcountries even protect themarriage ofthegays bymaking the laws ,in China itisstillconfusing about whether laws concerned should bemade toprotect therights togaymarriage.
