文档介绍：中文摘要中文摘要环境是人类生存和发展的基础,人类在不断走向现代化的过程中,创造了巨大的物质财富,但也带来了严重的环境破坏和污染问题,给人类自身的生存和发展带来严重威胁。环境问题已成为全社会、全人类普遍关心的热点问题,相关的立法和执法工作亦日益引起人们的关注。我国作为一个发展中国家,污染环境和破坏资源的情况相当严重,环境污染事件和破坏资源事件层出不穷。本文通过对我国现行的调整环境的法律和法规进行分析,指出其存在的缺点和不足及难以应对我国越来越严重的环境污染事件和破坏资源行为的现实。基于上述认识并借鉴域外环境刑事责任法律制度的经验, 本文提出了完善我国环境刑事责任法律制度的建议和构想,着重强调我国应制定环境保护的单行刑法,针对环境犯罪的特点,在所制定的单行刑法中规定与其他普通刑事犯罪不同的原则,扩大刑法的保护对象和范围,明确具体规定环境犯罪, 使执法者在追究环境犯罪行为入的刑事责任时有法可依,便于司法实践中操作和执行,进而提高司法效率,保障司法公正。制定单行环境刑法,使刑法更有针对性地保护环境,加大刑法对环境犯罪的处罚力度,有助于从根本上解决环境污染问题,更好地保护我国人民的生存环境,促进国民经济的可持续发展,增强我国在国际社会中的竞争力。关键词:环境污染;自然资源破坏;环境刑事责任;单行刑法;环境犯罪黑龙江大学硕士学位论文 Abstract Natural environment supports thebasis forsurvival and development ofhuman thefastproceeding ofmodem society,huge amounts ofphysical fortune, but also serious issuesofenvironmental pollutionand naturalresourc圮destruction have been made by human beings,which might endanger f-tll-thersurvivalanddevelopment of ,the issueofenvironment mon concem ofallthepeople in theworld,and more attention has been paid tolegislation and As adeveloping country,China isfacing、析th a heavy factofenvironmental pollution and natural resourcedestruction,as many caseshappen every on reviewing the current laws related toenvironmental crimeinChina,their ings insufficient todealwiththeseriousproblem ofenvironmental pollution andnatural resource destruction arelisted in this toexperience in oversea environmental criminalliability lawsystem,suggestion and approach topromote the constitution ofenvironmental criminal liability in our country arepresented by the author,emphasizing legislation oftheindividualcriminal law toprotectenvironment.
