文档介绍：论不起诉裁量权诉讼法专业研究生:徐种指导教师:李浩司法领域中的自由裁量权并不是完全依照法条的规定,而是在法律的范围内依靠人的主观能动性结合实际情况来行使,自由裁量权在司法领域中占有非常重要的地位,不仅法官在审判时拥有广泛的自由裁量权,在刑事诉讼中,检察机关所拥有的自由裁量权也极为关键。检察机关的自由裁量权的涵盖面非常广泛,贯穿了从侦查到庭审的阶段,在整个刑事诉讼中的作用是不言而喻的,而不起诉裁量权仅仅是检察机关自由裁量权中的一种。我国1996年的《刑事诉讼法》已经初步确立了检察机关的不起诉裁量权,近几年对于不起诉裁量权的理论研究和司法实践越来越深入,许多和不起诉裁量权的配套制度也陆续在尝试中,相对而言不起诉裁量权的法律明文规定和现实情形是不相符的。本文从分析自由裁量权和检察机关自由裁量权入手,分析了不起诉裁量权的定义,性质等等基本理论知识,还对其运行的基础进行了分析,同时介绍了英美法系和大陆法系的不起诉裁量权的情况,并分析了我国不起诉裁量权目前的状况和不足,在分析借鉴的基础上试图探讨中国的不起诉裁量权的合理构建。我国检察机关所行使的不起诉裁量权是一种程序上的权力,不起诉裁量权的完善对于我国面临的刑事诉讼的改革有着积极的推动意义。关键词:自由裁量权不起诉裁量权绝对不起诉相对不起诉存疑不起诉 Research on Discretion ofNolle Prosequi Major:Procedural Law Graduate student:Xu Chong Tutor:Li Hao Discretion is not totally ordance withthelaw inthejudicial field,but relies on people’Ssubjective initiative toCOBIlect practices inthe area ofthe law.
