的修改或者创设专门的保护制度。随后对传统知识的知识产权保护的制度框架的探讨也是遵循这一思路：首先对权利主体、权利内容、权利的取得和管理以及保护期限等相关基本要素进行了分析：其次分析并且评价了现有的知识产权制度对传统知识的保护；最后探讨了对现行的知识产权制度进行适当变革和创新，指出这种变革和创新可以从两个方面着手，一是修改程序性的规则间接的保护传统知识，二是通过创设知识产权的实体规则来直接保护传统知识。
笔者在文章的最后一部分对全文进行了总结，并且提出了对传统知识进行知识产权保护的热切期望。

ABSTRACT
The intellectual property protection on traditional knowledge(TK) is the chanllenge that the current intellectual property ！aw system faced have many differences with modem knowledge which is the mainstream of our socitey. These differences can be determined that the existing intellectual property law system is not essential to the effective protection ofTK. This paper is focused on "the protection of intellectual property rights of TK." And this paper proves tiie legitimacy and feasibility of intellectual property protection of TK .AT last,this paper discusses the the strategic objectives and the institutional fhunework.
In the first part,this paper introduces tiie origin of 似 s issue and the current status of researcL In recent years many countries and international organizations have been actively working on the issue/The second part analysis the definition of TK. Based on The first two third part discusses the intellectual property protection of the forth part^this paper in加duces the worldwide practice of the protection of TK.. In the fifth partthis paper discusses the stotegic objectives of intellectual property protection for TKJt points out that we should use the current intellectual property law system prior to protect TIC When resource of the cerrent law is exhausted,should we consider appropriate changes or the creation of a specid protection system. Then this paper discusses the institutional framework of the protection of intellectual property of TK. Finally, we discuss appropriate changes to the existing intellectual property system.
