文档介绍：湖南大学硕士学位论文侦查视角下毒品犯罪证据问题研究姓名:李卓瑞申请学位级别:硕士专业:法律硕士指导教师:黎四奇 20120320 侦查视角下毒品犯罪证据问题研究摘要随着全球经济政治一体化进程的不断深入,毒品问题已经成为世界各个国家普遍存在的社会问题,其深恶的影响已经使其成为当今世界的头等公害。作为我国社会缉毒部门的中坚力量,公安机关缉毒执法部门承担着打击毒品犯罪的重要职责,也是毒品犯罪证据实践应用的先导部门。证据是揭露和证实犯罪的有力武器,也是公安机关立案、侦查、逮捕、起诉的依据,因此妥善地收集、固定和运用毒品犯罪证据是缉毒侦查破案的主要内容和关键所在。但在侦查实践中,受刑事诉讼立法缺陷、现行法律法规的束缚以及毒品犯罪特殊性的影响,毒品证据的收集、固定和运用存在诸多问题,如证据种类单一、“口供"情节突出、关键证据无法公开出示、部分证据由于获取时采用的侦查手段存在争议而不被采信,认定犯罪嫌疑人主观“明知"难,作为主要人证的警察或特情出庭作证少等等,这些问题致使一些毒品犯罪案件因事实不清、证据不足而未能被追诉和判决,大大影响了对毒品犯罪的打击和处理力度。因此, 从侦查的角度仔细研究毒品犯罪证据的特点及运用难点对缉毒侦查实践具有重大的现实意义。剖析毒品犯罪、毒品犯罪证据及其收集方式的特殊性,比较和借鉴西方国家包括英美法系和大陆法系国家的刑事证据规则和制度以及毒品犯罪侦查实践现状,可以看出在理念层面上强化诉讼证据意识,提升收集和固定毒品证据的水平, 完善推定规则的适用,实行适度的自由心证,逐步建立和完善适合我国国情的刑事证据规则和制度;在实践层面上,加强技术侦察手段的规范化立法和规制,推广警察出庭作证制度,强化司法协作,将是解决缉毒侦查部门所面临的毒品犯罪证据应用瓶颈问题的趋势所向。关键词:毒品犯罪;证据;侦查实践硕十学位论文 Abstract With theintensification oftheintegration process ofglobal economics and the politics,the narcotics problem es thegeneral social problem ofthecountries all over theworld,which isconsidered scourge for itsextremely serious influence on thesociety and the thebackbone power ofthenarcotics restrictionadministration of our country,the Department Of Detective Investigation On The Crime Of Narcotics in the public security agencies affords theimportant responsibility of striking against the crime of narcotics and guides theevidence practice andapplication ofcrime ofnarcotics. Generally,the evidence isthestrong weapon ofexposing andconfirming the fact ofcrime,as well as the foundation of case setting up,detective investigation, arrestment and lawsuit activities,SO theproperly collection,fixation and application on evidence ofnarcotics crime e themain content and sticking point inthe detective investigation ofcrime of ,in the practice ofdetective investigation,the restriction of existing rules of law and the influence of the specificity ofnarcotics crime,the collection,fixation and application on evidence of narcotics e across SO many problems due totheflaw ofcrimina
