文档介绍：法律硕士专业学位论文职务犯罪案件中技术侦查措施的应用及检讨 Application and review of the technical investigation measures in the duty crime cases 作者姓名: 王俊杰指导教师: 施鹏鹏西南政法大学 Southwest University of Political Scienceand Law 万方数据 1 内容摘要新刑事诉讼法明确检察机关在查办职务犯罪案件可以采取技术侦查措施,从立法上正式确立了检察机关技术侦查措施的合法性,有利于实现打击职务犯罪和保障公民人权的高度平衡,也有利于侦查机关拓展侦查手段,提高办案水平和案件质量,实现侦查模式“由供到证”向“由证到供、供证互动”的转变。但该制度在立法上仅是原则性规定, 欠缺操作规范细则,需要进一步细化和明确。本文首先简单讨论技术侦查措施基础理论,然后详细讨论新刑诉法关于技术侦查措施的相关规定,接着探讨在目前理论上和司法实践中技术侦查措施仍然存在的缺失与困惑,提出相应的立法建议,期望技术侦查措施立法规定更加完备,在查办职务犯罪案件中能够发挥更大的作用。全文共分为四部分论述: 第一部分:技术侦查措施的基础理论。详细介绍了技术侦查措施的概念和类别,介绍了技术侦查措施的呈现的特征,需要把握的使用原则,及其重要意义等内容。第二部分:分析介绍技术侦查措施在我国的制度框架。重点介绍新《刑事诉讼法》中关于技术侦查措施的规定,同时对《联合国反腐败公约》等国际公约对技术侦查措施的相关介绍。第三部分:分析新《刑诉法》关于技术侦查措施规定的遗憾和缺失,阐述新《刑诉法》中缺乏对技术侦查措施概念和种类的规定,缺乏批准机关和批准程序的规定,缺乏相应的监督制约、权利救济机制,以及应用技侦措施种类单一,目的局限等缺失和不足。第四部分:针对第三部分提出的缺失和困惑,有针对性地提出对应的完善建议,包括:明确技术侦查措施的概念和种类,加强检察公安协同配合,明确批准机关和程序, 考虑赋予检察机关技侦实施权,加强对技术侦查的监督和制约,建立健全侵权救济机制, 拓展应用种类等内容。关键词:检察机关;职务犯罪;技术侦查;检讨;改革万方数据 1 Abstract The new Criminal Procedure Law has been clear about the procuratorial agency can adopt the measures of technical investigation, in handling duty crime cases. It is from the legislation formally established the legitimacy of the technical measures of the investigation of the procuratorial agency, not only conducive to the highly balanced realization of cracking down the crime and protect the human rights of citizens, but also conducive to the investigation agency to expand the investigation means, improving the level and quality of handling cases, realizing the transformation of the investigation pattern. However, the system is only stipulated in principle in the legislation. By lack of normative operation rules, it needed to be further refined and clear. This paper first briefly discusses technical investigation measures basic theory; next discusses the new Criminal Procedure Law in detail about the technical detection measure correlation stipulation; once more
