毒品犯罪的死刑适用研究
摘要
毒品犯罪是世界各国都予以严厉打击的犯罪形式,但在人权观念
深入人心的今天,毒品犯罪的死刑存废,成为值得关注的问题。我国
是在毒品犯罪上仍保留死刑的国家,目前乃至今后很长一段时间内不
可能废除,于是限制对毒品犯罪死刑的适用,不仅必要、而且迫在眉
睫。
本文中,对毒品犯罪适用死刑的探讨避开当前理论界二分法的争
论,笔者独辟蹊径,首先从现行刑法对毒品犯罪适用死刑的基本态度
入手,阐述刑事立法、刑事司法从严惩治精神;其次,从我国对严重
毒品犯罪适用死刑的事实根据、社会根据进行探讨,以及借鉴其他国
家和地区对毒品犯罪适用死刑的法律规定,得出我国还不能盲目废除
毒品犯罪死刑的结论;然而,笔者也看到了刑事立法规定死刑存在有
一定非正当性,毒品犯罪适用死刑有种种弊端,因此,对毒品犯罪限
制死刑适用是我国当前应有的选择。最后,笔者立足于我国现实情况,
在立法和司法实践中对毒品犯罪限制适用死刑作出了一些具体构想。
本文从理论到实践,反映社会、法制进步对限制、废除死刑的需
求,并结合工作实际对毒品犯罪死刑适用进行系统探究和分析,对中
国从毒品犯罪死刑适用到慎行到最终取消提供了理论和实际的依据。

STUDY ON DEATH PENALTY APPLIANCE
OF NARCOTICS CRIMES
ABSTRACT
Narcotics crime is a major type of drug-related crime around the
globe, which is drawing more and more concern in a human rights
focused world. While death penalty against such crimes remains
existence in China currently and as well for a long future, situations
leading to execution against narcotics crime should be well defined and
after all-around consideration.
Normally discussions against narcotics crime fall into two categories
in current theoretical field, while a different way is shown in this paper.
First, take a look at the tendency of stricter penalty against drug crime,
pare the legitimate and practical regulations between China and
other countries, as a result to emphasize the drawbacks of death penalty in
China. And lastly, vision of how to deal with drug crimes properly is
drawn based on daily experience in legitimate and judicial practice.
A trend to avoid death penalty against narcotics crime is shown in
this paper theoretically and practically, and basis to constrain and so on
finally abolish execution penalty is provided according to the analysis of
drug related crime cases from work.
