摘要：随着网络社会的发展，上网者把互联网当做对事物公开陈述和讨论的空间平台，于是网络公共领域形成。因此，相对而言，互联网所构成的社会网络空间，提供了一个全新的人类互动的场域，这个场域的部分空间形成了全新的公共领域。人们开始在网络社会中关注公众利益、公民社会与公共事务，而且参与的人越来越多，随之形成网络公共舆论规模，对社会的建构和进程产生广泛影响。
The abstract: With the development of network society, Internet users of the Internet as a public statement and discuss things space platform, and network formed in the public domain. Therefore, relative to character, the Internet，s structure of social network space, to provide a new field of human interaction, this field is part of a new space form the public domain. People began in online community concern the public interests, civil society and public affairs, and the participation of more and more people, then form a network public opinion scale, society construction has wide influence and processes.

引言：近年来，网络发挥的力量越来越大，越来越多的民众加入到了网民这一强大的隐形群体中，网民在网络上自由发表言论，甚至于网络社会中广泛达成的自由讨论和公众舆论逐渐是决策者也将网络意见纳入决策考虑。例如“李刚事件”、“小悦悦事件”、“华南虎事件”等都是经过网上热烈讨论，进而影响了现实社会中的决策和政府决策，网民在网络社会中拥有着高度的***的权利，成为一支不可忽视的舆论力量。
美国芝加哥大学桑斯坦教授在其所著的《自由市场与社会正义》一书的“The First Amendment in Cyberspace” 一章中。讨论了网络上的言论是否应该受到 ***保障的问题，并归纳出三点意见：(1)市场派(2)麦迪逊派(3)特纳派。市场派与麦迪逊派源于传统的自由言论之争。桑斯坦教授认为应回归到为何要有***的论点，民主社会之所以重视***，其真正精神应是为提升人类生活的福祉，以及实现所谓的社会主义。其目的无非是希望对社会有所助益。
同时，这样保护下的***才有意义。
