内容提要: 国家侵权精神损害是指因国家侵权损害自然人的人身权，致使其精神活动出现障碍而产生的身体上和精神上的痛苦，我国《国家赔偿法》上应建立国家侵权精神损害赔偿制度;国家侵权精神损害赔偿的范围应当包括物质性人格权侵害的赔偿和精神性人格权侵害的赔偿;赔偿请求权人仅限于受到精神损害的自然人，不包括法人和其他组织;国家侵权精神损害赔偿应确立“金钱赔偿为主，精神补救为辅”的原则，算定精神抚慰金时应兼采“不同损害不同赔偿”和最高赔偿限额两种方法。
