文档介绍：中南民族大学硕士学位论文 I 摘要改革开放以来,大量的农村富余劳动力向城镇转移,逐渐形成了一个庞大的社会群体,即“农民工”。由于农民工身份地位的特殊性,使其在城市生活中经常受到歧视性待遇,农民工权利遭遇侵害的事件也时有发生,这样的状况违背了平等、公正的法律价值,也不利于我国构建和谐社会和建设社会主义法治国家。近年来,我国政府各部门对农民工问题给予了高度的重视,相继出台了一些保护农民工权利的政策法规,然而,根据对目前实际情况的考察,农民工权利遭遇侵害的状况仍然存在,农民工的权利并没有得到有效的保障。因此,农民工权利的法律保护值得我们作进一步的研究。本文除引言与结语之外,主要由三个部分构成。第一部分,阐述农民工权利法律保护的价值。笔者在分析已有相关文献的基础上, 对“农民工”作如下定义:农民工是指在中国特定阶段存在的,具有农村户口,有少量的承包土地,但主要从事非农业生产,常年在城镇工作或就业的,以工资为主要收入来源的劳动者。农民工享有的权利是广泛而复杂的,从现状来看,农民工的迁徙自由权、政治权利、劳动权利、社会保障权、受教育权尤其重要。加强农民工权利的法律保护, 其价值在于:有利于维护平等,实现社会正义;有利于化解矛盾,保障社会稳定;有利于促进经济发展;有利于推动民主化建设和法治化进程。第二部分,考察农民工权利法律保护的缺失。笔者认为,农民工权利法律保护的缺失主要表现在如下方面:迁徙自由权遭受限制,政治权利行使困难,劳动权利屡遭侵害, 社会保障权保护缺失,受教育权缺乏保护。二元社会结构不合理、平等思想观念缺乏、法律保障供给不足、行政执法不力、工会维权组织缺位等是导致农民工权利法律保护缺失的重要原因。第三部分,提出加强农民工权利法律保护的建议。笔者认为,加强农民工权利的法律保护首先要确立平等保护与特殊保护相结合的原则。推进户籍制度改革是加强农民工权利法律保护的重要措施,修改现行《劳动法》中的不合理规定、完善社会保障立法与法律援助制度是健全农民工权利法律保护的重要内容。除此之外,还应加强行政执法力度,充分发挥工会的维权作用。关键词:农民工;权利;法律保护论农民工权利的法律保护 II Abstract Since China introducedreform and opening policies, a large number of the surplus agricultural labor has started to flow from rural to urban areas, A large social group ing into being ,they are migrant workers .because of the particular characteristics of migrant workers, they often received raw treatment in cities, infringement on them occurs from time to time ,This is not in accord with the legal value of equality and justice, and it is go against to building harmonioussociety and building a socialist country of law.
