近代日本民事立法的启示
——关于中国民法典编纂方针的几点思考

在19世纪至20世纪初，世界范围的近代民事立法活动中，同处于亚洲的日本和中国都进行过编纂民法典的尝试，但得到的结果却不相同，这就是众所周知的，日本成功地制定了直至今日仍在适用的现行日本民法典，该民法典对日本近代国家的崛起，对后来日本的现代化建设和法治国家建设都发挥了无以替代的重要作用，而清末的“大清民律草案”则只为后来“中华民国民法”的编纂做了某种程度上的准备(当然，我们不能忽视这种准备在中国民事立法史上的重要作用)。
今天，正当我们在新的历史条件下，为巩固上一世纪七十年代末开始实施改革开放政策，大力发展市场经济以来取得的胜利成果，适应向着国际市场迈进的需要，进一步完善国家的民事法律制度，而再次开始我国的民法典
