文档介绍：内容摘要内容摘要宽严相济刑事政策是我国现阶段惩治与预防犯罪的基本刑事政策,其形成与提出并非偶然,它是在我国创建和谐社会的背景下,是在对严打政策反思和纠正, 以及对惩办与宽大相结合政策的继承和发展的基础上,为应对日益繁杂的犯罪现象,并在追求刑罚效益和有效节省司法资源的要求下产生的。检察机关作为法律监督机构,在维护社会和谐稳定中肩负着重要的职责,必须准确把握宽严相济刑事政策的本质与内涵,深刻认识宽严相济刑事政策的时代意义与定位,在检察工作中贯彻落实宽严相济的刑事政策,努力提高服务社会主义和谐社会建设的水平和能力。目前,宽严相济刑事政策在司法实践中有两种倾向,一是谈到宽严相济刑事政策,往往将之等同于轻缓化的刑事政策,认为贯彻宽严相济就是应当对犯罪从宽处理。另有一部分人则****惯用“严打”的思维来适用宽严相济刑事政策,一味强调从严打击,导致宽严相济刑事政策在检察运用中出现宽的不合理,严的未到位的执法不规范现象。本文从检察实践出发,对宽严相济刑事政策在检察工作运用中宽严失衡的成因进行分析,对在检察实践中如何准确把握、全面贯彻宽严相济刑事政策提出改进建议,以期抛砖引玉,引起大家对宽严相济刑事政策的深入研究。关键词:刑事政策;宽严相济;检察机关 ABSTRACT ABSTRACT As riminalpolicy inChina topunish andprevent crimesincurrentstage, theformation and propose oftemper justice withmercy is not by chance,but under thebackground ofcreating harmonious society,introspecting and correcting the “strike-hard’'policy,as well as basing on theinheritance and development bining punishment withleniency andunder therequirement ofseeking efficiency ofcriminal penalty and saving judicial resource effectively to fight against the plicated ajudicial an,the procuratorial authority hasanimportant tasktomaintain theharmony and stableof society,it’Snecessary tograsP accurately theessenceandconnotation oftemper justice wiⅡlmercy,to understand deeply itstimesignificance andposition,to carry out itinprocuratorial work,to improve our ability ofserving forconstruction of a harmonioussociety.
