股权强制执行的条件主要有:1、实体条件,包括作为被执行人的股东必须没有其他可供执行的财产,或是其他财产虽经执行却仍不足以清偿债务、必须保证其他股东的优先购买权、不能破坏资本维持原则;2、程序条件,包括要有强制执行的相关依据、应履行通知义务、范围应限于执行依据所确定的数额及执行费用、必须进行价值评估、首选拍卖的方式处理股权。
本文从就对股权的强制执行从其法律属性、我国法律的有关规定、我国司法实践运用等方面进行探讨,以期对股权执行制度完善有所助益。
