INTRODUCTION AND SUMMARY The dangers to a free society that are implicit in the use of secret intelligence informers have long been recognized. In his Constitutional History of England, written in the mid-19th century, Sir Thomas May observed: Men may be without restraints upon their liberty; they may pass to and fro at pleasure: but if their steps aretracked by spies and informers, their words noted down for crimination, their associates watched as conspirators - -who shall say that they are free? 1 May pointed to the use of informers by "continental despotisms," noting that "the freedom of a country may be measured by its immunity from this baleful agency." 2 On the other hand, law enforcement officials see informants 3 as a highly effective technique --one justified by the public's interest in the detection of crime and the prosecution ofcriminals.
