文档介绍：分原创性声明本人声明,所呈交的学位论文是本人在导师指导下进行的研究工作及取得的研究成果。尽我所知,除了论文中特别加以标注和致谢的地方外,论文中不包含其他人已经发表或撰写过的研究成果,也不包含为获得中南大学或其他单位的学位或证书而使用过的材料。与我共同工作的同志对本研究所作的贡献均已在论文中作了明确的说明。作者签名:盘!塾整日期:丛年上月三绸摘要课征金制度是日本反垄断法特有的行政责任制度。自1977年引入以来,经过三十余年间几次重大的修改,课征金制度已经成为日本反垄断法责任制度的核心,对保障日本反垄断法的实施起到了积极的作用。课征金制度内容框架的设置主要分为四个基本方面:课征金征收的对象行为;课征金金额的计算方法;基于宽大处理机制的减免制度;课征金的征缴程序。从课征金制度的内容以及发展历程来看,都是极富日本特色的。在性质上,与其他国家的行政罚款制度不同,课征金是兼有没收违法所得与行政罚款的双重性质的;相比各国反垄断法而言,其在制度设计上较为僵化;在实施机制上,具有实施机构唯一和程序设置高度效率的特征;从其发展来看,判例法的推动起了很大作用。由于日本与我国的法律文化以及国情上有许多相似之处,课征金制度的优点值得我国反垄断法有针对性的加以借鉴。我国在反垄断法总体的法律责任制度的选择上,应当坚持“行政罚款中心主义”的做法,这不仅是世界反垄断法的普遍做法,也是反垄断法“慎刑"原则的要求。此外,我国应当立足自身国情参考课征金制度的经验对行政罚款制度从以下几个方面进行完善:行政罚款的上限额度应当达到巨额的程度;对减免制度适用规则加以明确;适当限制行政罚款的自由裁量权;对中小企业应予以适当的照顾。关键词:课征金制度,反垄断法,行政罚款 ABSTRACT The surchargesystem,as aunique style ofadministrativefine,has been the core oftheliability system ofthe Japenese Antimonopoly Act(theJAMA)and played anactiveroleinpromoting theenfocement of theJAMA by severalrevisions during more than 30years,since its introductionin content ofthesurcharge includesfouraspects: theobject behaviour ofthesurcharge;putational method ofthe surcharge;theleniency;theprocedure content and thedevelopment ofthesurcharge both have great Japenese ofthelegalnature,the surcharge both have the functions ement ofundue profit and penalization ofthe illegal ’S a very rigid administrative pared with thefinesystem of theantimonopoly lawofothercountries. 硒eJapanese mission petent authorities who charge thesurcharge system,and thedesign ofitsprocedure attach more attention case lawhaveplayed animportant role inthedevelopment ofthesurcharge.
