文档介绍：论文摘要保护金融消费者是美欧等金融市场发达国家或地区金融监管的核心目标之一(FSA,2001),也是国际立法趋势。近年来,我国金融领域侵害消费者权益的情形频繁发生,主要集中表现在三个方面:侵害消费者知情权、公平交易权和隐私权。而我国的相关法律对金融消费者尚无准确的界定,金融消费者没有列入《消费者权益保护法》的保护范畴,其他涉及金融消费者保护的内容散见于诸多法律法规和部门规章中。我们应借鉴美欧等国金融改革的有益经验,逐步完善我国金融消费者权益保护法律制度。本文首先界定了金融消费者概念、保护范围及其基本权利,分析了我国金融消费者权益保护的现状和问题,并系统比较了美国、英国和日本的金融消费者保护相关法律,然后基于上述分析从我国金融消费者保护的立法模式与立法原则、立法内容等方面探讨如何完善我国金融消费者权益保护法律体系。本文的研究认为,在立法模式上,我国宜选用渐进立法模式,近期对《消费者权益保护法》进行修改,扩大解释消费者的含义,或是在该法中对金融消费者保护进行专章规定,待条件成熟时,再采用专门立法模式;金融管制立法应贯彻对金融消费者的倾斜保护、全面保护、适度保护和分类保护的原则;当前,对金融消费者知情交易权的保护是我国当前金融消费者保护迫切需要重点解决的问题;为保证金融消费者权益保护法律的有效实施,相关立法中应设立具有监督、检查和执行权等一系列明确权力的专门监管机构,建立一套具备可操作性的金融消费纠纷解决机制,并强调进行金融消费者教育。关键词:金融消费者,消费者权益保护,金融监管,金融消费知情权 ABSTRACT The protection offnancial consumers is one of core objectives offinancial supervision and theinternationallegislative trendsin theUnited States,Europe and other developed countries(FSA,2001).In recent years,the typical cases against the mainly inthreeaspects:the right to consumers trading ,China's relevant laws have no precise definition financialconsumers are notincluded intheprotection areas of”Consumer ProtectionLaw”.and other contents scatteredin various regulations and department should lealTlfromthefinancialreforms gradually improve thefinancial consumer protection legalsystem.
