文档介绍:II III 论我国破产重整中管理人制度的完善中文摘要中文摘要随着近年来世界经济的衰退与复苏,国内的市场经济也随着世界经济的大潮, 潮涨潮落。有些企业在这波大潮中,由于各种原因濒临破产,但是当经济复苏的良好前景到来时,有的企业有了起死回生的希望,他们运用破产法中的重整制度重新振作起来,作为一个经济实体为社会的发展、自身价值的实现做着自己的努力。在重整中,破产管理人功不可没,但是由于我国引进破产管理人制度时间不长,立法尚不完善,在很多地方缺乏实践经验,于法条又无可操作性,重整中的管理人在实际工作中面临重重困难。本文试图从笔者所在单位审理的破产重整案件了解破产管理人制度现实存在的问题,建立一个合理的重整中破产管理人制度。文章分五个部分,第一部分介绍所提问题的相关背景,第二部分重在从理论角度论述重整中管理人的法律地位,第三、四、五部分从选任制度、监督制度、薪酬制度三个方面剖析现实存在问题,阐述笔者完善破产重整中管理人制度的构想。关键词: 破产重整破产管理人选任制度监督薪酬体系作者:戚慧指导老师:李中原 I Abstract On Perfection of the bankruptcy anization supervisor system A Study on improving administrator legal system of bankruptcy anization Abstract As the recession and recovery of the world economy in recent years, domestic market economy and with the tide of world economy, the changing of the tides. panies in this wave, on the verge of bankruptcy due to various reasons, but when the good prospects of economic recovery, some enterprises have the hope ing back to life, they use the anization system in bankruptcy law to cheer up, asa economic entity for the development of the society, the realization of his value todo their own efforts.
