　　配偶权中的相互扶养、扶助权和同居义务，具有相对权的性质，作为侵权客体，其特点是，侵权行为的主体有双重性，一是负有义务的一方当事人，即配偶的一方;二是配偶以外的第三人对负有义务的配偶一方进行侵害，造成该方配偶不能对对方配偶履行义务，使对方配偶的权利遭受损害。从纯粹的侵权法角度上说，这种侵害配偶权行为是指后者，例如，侵害配偶一方身体造成残废或死亡，使受扶养一方配偶扶养权的丧失，构成侵权行为。
　　此种侵权行为，《民法通则》第119条已有明文规定，最高人民法院关于贯彻执行《民法通则》的司法解释也有明确规定。配偶一方与第三人串通，或者第三人强制配偶一方，不尽扶养义务，亦构成侵权行为，有共同意识联络的，还构成共同侵权行为。第三人侵害配偶一方权利，致使其不能向对方配偶履行扶助义务或同居义务的，难认其为侵权行为，应依其他法律调整。对于配偶一方不尽扶养义务、扶助义务和同居义务的，应当依照婚姻家庭法律进行调整，追究违反法定义务一方的责任，如构成虐待、遗弃罪的，应依法追究其刑事责任，以保护权利人一方，在民法上，也构成侵权责任。在现代民法理论中，侵害配偶权的侵权行为，主要是指对配偶权中的忠实义务的侵害，即第三人与配偶一方通奸或者重婚，而使对方配偶的身份利益受到侵害的行为。对于实施家庭暴力伤害配偶，以及虐待、遗弃配偶的，也构成《婚姻法》规定的侵害配偶权的精神损害赔偿。
