摘要
当前,随着我国改革开放的不断深入,社会处于转型期。社会矛盾与冲突日
显激烈,引发了各类群体性事件。这些事件的发生,严重威胁着我国当前社会的
和谐与稳定。虽然目前国内对于群体性事件已经有一定数量的研究成果,但在这
些研究成果中,大多将群体性事件作为政治学、社会学、治安、刑事问题来进行
主导性界定,更多讨论的是现场处置的方式和对策,缺乏对群体性事件深入的法
理剖析,应对机制存在着片面性与局限性。对当前中国而言,法治已不是一个是
否可能的问题,而是一个如何现实操作的问题。目前关于中国法治理论的研究,
往往注重于“法治是什么”的规范性分析。缺少应有的对法治社会根基的分析研
究,法律制度难以由纸面规则变成生活中的现实规约,适合中国国情的现实法治
秩序也没能建立。本文以法治的视角、法治的语境、法治的思维对群体性事件这
一现象进行了深入解读,在研究如何以法治机制应对群体性事件的同时,阐述了
法治应对群体性事件的价值与意义。论文共分为三大部分。在第一部分紧密联系
我国当前群体性事件的新特点、新趋势,从我国群体性事件的概念厘清、显著特
征、本质属性入手,详细阐述了群体性事件的现状,在说明当前国内大多文献中
用政治定性来界定群体性事件的危害的基础上,进一步分析了当前的群体性事件
的法理本质;在第二部分,笔者站在法治的立场,以法治的视角审视并详细分析
引发群体性事件的利益失衡、诉求不畅、公权失范、司法不彰等深层根源;在论
文的第三部分,针对引发群体性事件的深层根源,结合我国现阶段国情,探讨法
治应对群体性事件的“应然”思维与机制,破除其“人治化”的倾向,以法治的
机制引导其向着良性互动的方向发展,为促进社会稳定、建设法治国家、和谐社
会提供更为系统的理论借鉴。

At present, with the deepening constantly of reform and opening-up of our country,
the society is in transformation period. Social contradiction and conflict showed fiercely
e increasingly intense, initiated all kinds of group events. These events, is
threatening harmony and stability of the present society of our country seriously.
Although there are certain amounts of research results to group at
present, However, the results of these studies, the majority of the group event as a
political, security and criminal issues to be the dominant definition, Lack of group
events in-depth legal analysis, the existence of response mechanisms and limitations of
one-sidedness. As to present China, it has not already been whether one has been a
possible question to the rule of law, but what a question that reality is operated is one.
