第一章总则
第一条为了适应昆明市经济建设和社会发展的需要，加强政府对工程建设项目招标投标的管理，规范建筑市场交易行为，提高建设工程质量和投资效益，促进建设工程廉政建设，维护护市场主体各方合法权益，构建公开、公平、公正交易，合法有序的竞争平台，以营造良好的经济社会发展投资软环境的目的，根据《中华人民共和国招标投标法》、建设部《工程建设施工招标投标管理办法》、《房屋建筑和市政基础设施工程施工招标投标管理办法》（建设部89号令）、《评标委员会和评标方法暂行规定》（七部委12号令）《云南省建设工程招标投标管理条例》的要求，结合我市实际，制定本办法。
第二条凡在本市行政区域内非生产性项目总投资在50万元以上、生产性项目总投资在150万
市人民政府建设行政主管部门的授权，具体负责本行政区域内施工招标投标的管理工作。主要职责是：
（一）审查招标文件、招标条件；为保证潜在投标人的保密，招标办不再复审投标单位的资格；
（二）审查招标申请书，为保证潜在投标人的保密，招标办不再复审投标单位的资格；
（三）组织审定标底；
（四）监督指导开标、评标、定标工作；
（五）否决违反招标投标规定的定标结果；
（六）监督承发包合同的签订和履行。
第七条建设工程项目招标投标按项目建设规模、隶属关系和投资来源，实行分级管
