TRADE PROTECTIONCandidate: Supervisor: Academic Degree Applied for: Speciality: Affiliation: Date of Defence: Degree-Conferring-Institution: Wang Xiaobin Associate Prof. Li Shuxia Master of Economics International Trade School of Humanities and Social Science June, 2008 Harbin Institute of technology 哈尔滨工业大学经济学硕士学位论文摘要随着知识经济和经济全球化的到来,知识产权对于世界经济的影响日益增强。近年来在中美贸易中美国的新贸易保护主义的措施不断增加,知识产权的有效保护成为美国扭转对外贸易状况的关键,中美两国有关知识产权的三次激烈争端都是围绕美国依据美国贸易法“特别301条款”对中国提起特别301调查并实施贸易制裁而展开。随着中美贸易的不断发展,特别在中国加入WTO后,中美之间的知识产权摩擦不但没有减少而且有越来越多的迹象,并出现了新的变化,即美国更多地动用“337条款”对中国企业和公司进行起诉,这不单是一种方式方法的变化,它同时表明了美国由保护本国产品在中国市场的利益为主转向了限制中国产品进入其市场为主。这一转变,为我国产品进入美国市场设置了重大的障碍,必须认真对待。在中美贸易中美国不断地利用知识产权来保护其跨国企业利益,中美未来的贸易战,将是由知识产权问题所引发的。鉴于此,对美国的知识产权壁垒进行积极充分的研究,并提出应对它的策略,具有重要的理论及现实意义。通过理论分析和实证分析可以得出结论,美国的“特别301条款”和“337条款”就其实质来说是一种新贸易保护主义的知识产权壁垒。在中美知识产权博弈中,处于劣势的中国应当从国家、行业、企业三个层次分别采取针对美国的知识产权壁垒的知识产权策略,来不断地壮大自己在知识产权领域的实力,削弱美国的知识产权壁垒对于我国经济发展的不利影响,赢得更好更快的发展。关键词知识产权;新贸易保护主义;知识产权策略- I - 哈尔滨工业大学经济学硕士学位论文Abstract With ing of knowledge-based economy and globalization, intellectual property has more and more influence to the world recent years,the new trade protectionism measure was taken more and more by . government, the effective protection of IPRs stands at the core of the improvement of their trade situation.
