农村土地承包经营权流转的现状、
分析及其法律思考

摘要: 通过对现实中农村土地承包经营权流转现状的介绍和理论分析, 认为农民缺乏流转意愿是导致流转行为未广泛
发生的根本原因, 而在流转向产业化方向发展迅速的地方, 公权力主体或农民集体组织都发挥了重要的推动作
用; 基于此, 对现行的农村土地承包经营权流转相关法律制度和规范在促进土地承包经营权流转方面的作用进行
反思, 并提出制度完善和构建的建议。
