第二章 职责分工
第七条 人民法院履行以下职责：
〔一〕对拟实行社区矫正的被告人，需要调查对其所居住社区影响的，委托县〔市、区〕司法行政机关进行调查评估；
〔二〕对被告人、罪犯依法作出判决、裁定或者决定；
〔三〕依法做好社区矫正法律文书和社区矫正人员衔接工作；
〔四〕依法审理撤销缓刑、假释以及对暂予监外执行罪犯决定收监执行的案件；
〔五〕依法审理社区矫正人员的减刑案件。
第八条 人民检察院履行以下职责：
〔一〕对人民法院、监狱、看守所刑罚交付执行活动的合法性进行监督；
〔二〕对司法行政机关执行社区矫正活动的合法性进行监督；
〔三〕对司法行政机关、人民法院、监狱、看守所变更刑罚执行活动的合法性进行监督；
〔四〕对社区矫正活动中发生的职务犯罪案件进行侦查，开展职务犯罪预防工作；
〔五〕其他依法应当行使的监督职责。
第九条 公安机关履行以下职责：

〔一〕对违反治安管理规定和涉嫌犯罪的社区矫正人员及时依法处理，对违反人民法院禁止令的社区矫正人员给予治安管理处分；
〔二〕对人民法院依法裁定撤销缓刑、假释或决定暂予监外执行罪犯执行收监的在逃罪犯，由公安机关负责追逃，司法行政机关协助;
