在目前的司法环境下由于律师在侦查阶段不具备“辩护人〞的诉讼地位，因此在维护被追诉人权益上作用有限。与律师不具备辩护人地位的规定相对应，犯罪嫌疑人在侦查阶段不仅不能享有选择律师的权利、得到及时有效的律师辩护和帮助，也不享有“不被强迫自证其罪〞的特权。因此，在目前这样的状况下，虽然多数刑事辩护律师都认为需要争取一个良好的执业环境，也付出了很多的努力，但在办理一些具体案件的时候，由于受到种种限制，又普遍对侦查阶段的工作不够重视。由于侦查阶段是刑事司法程序中犯罪嫌疑人权利最容易受到侵害的诉讼阶段，所以作为律师应该充分利用法律赋予的权利，尽最大可能为犯罪嫌疑人提供一些切实有效的法律帮助，最大限度的维护其合法权益。
