一、WTO法律体系的性质
美国学者约翰·杰克逊将国际经济法定义为：处理跨国交易中涉及贸易、投资与效劳问题，以及与来自于域外的个人或企业在域内的经济活动有关问题的法律 [1]。由此来看，WTO法律体系无疑属于国际经济法的范畴。但是，国际经济法是一个范围庞大的国际法大学科划分，包含国际贸易法、国际金融法、国际投资法、国际商法、国际银行法、国际商事仲裁、国际环境法、国际税法等诸多法律学科。进一步划分可以看出，WTO的法律体系应当属于国际经济法中的国际贸易法学科。
关于国际贸易法的研究范畴，目前，是一个颇具争议的学术问题。笔者认为，应将管理性质，调整国际贸易中政府宏观贸易行为的国际法律规那么，如WTO法律体系、?***贸易协定?〔NAFTA〕、欧盟法〔European Union Law〕，以及政府调整国际贸易行为的国内法律规那么，如原产地规那么、反倾销规那么、反补贴规那么、保障措施规那么等，与交易性质，调整国际贸易中私人具体商事交易行为的法律，如?国际货物买卖合同公约?〔Convention on International Sale of Good
