    〔四〕征地拆迁中按产权调换或货币方式进行安置补偿的；
    〔五〕夫妻离婚未满2年申请宅基地的〔一方已再婚的除外〕；
    〔六〕不符合法律、法规、规章规定的其他情形。
    第八条  农村居民分户申请宅基地必须同时符合以下条件：
    〔一〕户主必须到达法定结婚年龄；
    〔二〕属本集体经济组织土地承包方并承当相应义务。
    第九条  有以下情形之一的农村居民，不得以分户为由申请宅基地：
    〔一〕丈夫与妻子之间；
    〔二〕子女与父母之间；
    〔三〕孙子女与祖父母之间。
    第十条  农村居民申请宅基地除户籍在册人员外，以下人员可计入本户人口：
    〔一〕家庭成员中的在校大中专院校学生；
    〔二〕家庭成员中的现役义务兵；
    〔三〕家庭成员中在服刑、劳动教养的人员；
    〔四〕法律、法规、规章规定可计入的其他人员。
    第十一条  农村居民一户只能拥有一处宅基地，宅基地面积标准为：1人户每户60平方米，2人及2人以上户每户120平方米。
    第十二条  农村居民建房应当按照具体的村庄规划进行建设，建筑层数控制在4层以内，。建筑外观样式应按照统一设计要求建造。
