Despite the relevant provisions of the Criminal Law and the Judicial Interpretation of the Supreme Court, it is still necessary to study and explore the controversial issue of escaping from traffic accidents. The current law severely punishes the perpetrators who escape after a traffic accident, considers how to identify the "escape" and how to make different j udgments according to the specific situation of the perpetrators in practice, and seeks concrete ways to deal with the "escape behavior" of traffic accidents in practice, so as to facilitate public understanding and take active measures to alleviate the perpetrators'fear after a traffic accident, lb implement, accept the law, accept the treatment opinions, reduce "escape", avoid the consequences that the injured can not be timely rescued, so that the actors take the initiative to take the obligation of rescue, and promote the harmonious development of society.
The first part expounds the concept of hit-and-run behavior; The second part analyzes the nature of hit-and-run, and discusses in detail the conditions of conviction and general aggravated punishment, as well as the death caused by hit-and-run. The third part analyzes the conditions of escape; The fourth part
is about the boundary between escape and other crimes.
