如何应对知识产权滥用: 分析与对策

摘要: 知识产权制度自创设之初就赋予了其鼓励创新和促进技术传播的双重功能, 然而目前
愈演愈烈的知识产权滥用行为阻止了这一功能的实现, 使得知识产权制度成为权利人垄断市
场、限制竞争、遏止创新的工具。我国已经建立起了符合 TRIPS 协议要求的知识产权制度框
架, 但很不完善, 尤其在规制知识产权滥用方面。我们应该借鉴发达国家的成功经验, 优化我国
的知识产权制度, 从而使其真正成为促进创新、实现技术进步的有力工具。

Abstract: Since the beginning of its creation, the intellectual pr operty system has born dual function of
encouraging innov ation and facilitating technolog y disseminatio n. H ow ev er , the current increasing ly ram -
pant abuse of intellectual property rights has prev ented the realization o f this function, transfo rming the
